By clicking "I Agree," creating an account, or accessing or using the Monster Gaming AI Platform (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.
2.1 Age. You must be at least eighteen (18) years of age to use the Platform.
2.2 Corporate Authority. If you are accessing the Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2.3 Geographic Restrictions. The Platform is not available in jurisdictions subject to United States sanctions or to any person restricted under U.S. export control laws.
3.1 You must provide accurate and complete information when registering for an account.
3.2 You are responsible for maintaining the confidentiality of your login credentials and API keys.
3.3 You must promptly notify Luxedeum of any unauthorized use of your account or any other breach of security.
3.4 Luxedeum may require multi-factor authentication (MFA) or single sign-on (SSO) at its discretion.

5.1 Ownership. You retain all ownership rights in content you submit, upload, or create through the Platform ("User Content").
5.2 License Grant. By submitting User Content, you grant Luxedeum, LLC a worldwide, non-exclusive, royalty-free license to host, process, analyze, and display such content solely for the purpose of operating the Platform and improving the services.
5.3 Responsibility. You are solely responsible for ensuring you have all necessary rights and permissions for any User Content you submit.
6.1 No SLA. The Platform is provided on an "as is" and "as available" basis. Luxedeum does not guarantee any specific level of uptime or availability.
6.2 Maintenance. Luxedeum may suspend or restrict access to the Platform for scheduled or emergency maintenance without liability.
Luxedeum may suspend or terminate your access to the Platform at any time for breach of these Terms, security concerns, legal requirements, or at its sole discretion. You may stop using the Platform at any time.
You agree to indemnify, defend, and hold harmless Luxedeum, LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your User Content.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. LUXEDEUM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL LUXEDEUM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM.
LUXEDEUM'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS (USD $100) OR THE TOTAL AMOUNTS PAID BY YOU TO LUXEDEUM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
All Platform technology, including but not limited to software, AI models, APIs, documentation, and content, is owned by Luxedeum, LLC or its licensors and is protected by applicable intellectual property laws. No rights are granted to you except as expressly stated in these Terms.
If you believe that content on the Platform infringes your copyright, please submit a notice to legal@monstergaming.ai that includes:
Luxedeum may remove allegedly infringing content and may terminate the accounts of repeat infringers.
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference.
Luxedeum may update these Terms at any time. Updated Terms will be posted on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. Material changes will be communicated via email or in-platform notice.
You agree to comply with all applicable export control laws, including the U.S. Export Administration Regulations (EAR) and the Office of Foreign Assets Control (OFAC) sanctions. You shall not use the Platform in any country or territory subject to comprehensive U.S. sanctions, nor shall you provide access to any person or entity on a restricted party list.
15.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of laws principles.
15.2 Binding Arbitration. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Clark County, Nevada.
15.3 Class Action Waiver. You agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action.
These Terms constitute the entire agreement between you and Luxedeum with respect to the Platform. No waiver of any provision shall be deemed a further or continuing waiver. If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect. Luxedeum may assign these Terms without restriction; you may not assign your rights or obligations without prior written consent.

This addendum applies to enterprise, co-development, and strategic partner engagements.
A.1 Enhanced Features. Enterprise customers may receive access to enhanced features, dedicated support, and custom integrations as defined in a Statement of Work (SOW).
A.2 Co-Development IP. Unless otherwise agreed in writing: (a) all Platform intellectual property remains the exclusive property of Luxedeum; (b) all customer-owned intellectual property remains the property of the customer; (c) any jointly developed intellectual property shall be owned by Luxedeum, with the customer receiving a non-exclusive, perpetual license to use such joint IP in its own products.
A.3 Feedback. Any feedback, suggestions, or ideas provided to Luxedeum may be used freely by Luxedeum without obligation or compensation.
A.4 Non-Compete. During the term of the enterprise engagement and for twelve (12) months thereafter, the enterprise customer shall not develop, market, or distribute AI-powered game engines or game development platforms that directly compete with the Platform.
A.5 Security Requirements. Enterprise customers must comply with SSO, role-based access control (RBAC), and audit logging requirements as specified by Luxedeum.
A.6 Service Levels. No service level agreement (SLA) applies unless expressly defined in a SOW.
A.7 Termination Effects. Upon termination of an enterprise engagement, the customer's access to enhanced features shall cease. Data export will be made available for thirty (30) days following termination.
B.1 License. Subject to these Terms, Luxedeum grants you a limited, non-exclusive, revocable license to access and use the Platform's APIs solely for the purpose of integrating with your applications.
B.2 Rate Limits. API usage is subject to rate limits. Exceeding applicable rate limits may result in throttling or temporary suspension of access.
B.3 Usage Tiers. API access is provided under the following tiers: Free, Partner, and Enterprise. Each tier has distinct rate limits, feature access, and support levels as described on the Pricing page.
B.4 Reverse Engineering. You shall not reverse engineer, reconstruct, or derive the underlying architecture, algorithms, or data structures of the APIs.
B.5 API Key Security. You are responsible for maintaining the security of your API keys. You must not share, publish, or embed API keys in client-side code or public repositories.
B.6 Monitoring. Luxedeum reserves the right to monitor API usage for security, abuse prevention, and compliance purposes.
C.1 No Training Use. You may not use outputs generated by the Platform to train, fine-tune, or improve any machine learning model, whether your own or a third party's.
C.2 External AI Restriction. You shall not input Platform data, outputs, or proprietary information into external AI systems (including but not limited to ChatGPT, Claude, or Gemini) where such input would result in training or retention by the external system.
C.3 Output Accuracy. AI-generated outputs are provided "as is" and may be inaccurate, incomplete, or inappropriate. Luxedeum makes no representations or warranties regarding the accuracy or reliability of any output.
C.4 No Reliance. You shall not rely on AI-generated outputs for legal, financial, medical, or operational decisions without independent verification.
C.5 No Model Extraction. You shall not attempt to extract, replicate, or distill the Platform's AI models through systematic querying, prompt injection, or any other technique.
C.6 No Competing AI Systems. You shall not use access to the Platform to develop AI systems that compete with the Platform's core functionality.
D.1 Roles. For the purposes of the General Data Protection Regulation (GDPR), the customer acts as the Data Controller and Luxedeum acts as the Data Processor.
D.2 Processing Instructions. Luxedeum shall process personal data only on documented instructions from the Data Controller, unless required by applicable law.
D.3 Data Categories. Categories of personal data processed may include: unique identifiers, business contact information, usage data, and technical data (such as IP addresses, device identifiers, and browser information).
D.4 Security Measures. Luxedeum implements appropriate technical and organizational measures, including encryption in transit and at rest, access controls, logging, and incident response procedures, aligned with ISO 27001 standards.
D.5 Subprocessors. Luxedeum may engage subprocessors, including cloud infrastructure providers and analytics services, subject to contractual protections substantially equivalent to those in this addendum. A list of current subprocessors is available upon request.
D.6 Data Subject Rights. Luxedeum will assist the Data Controller in fulfilling data subject requests (access, rectification, erasure, portability, and objection) to the extent technically feasible.
D.7 Breach Notification. Luxedeum shall notify the Data Controller of any personal data breach without undue delay after becoming aware of such breach.
D.8 International Transfers. Where personal data is transferred outside the European Economic Area, Luxedeum shall ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) as approved by the European Commission.
D.9 Data Deletion. Upon termination of the agreement, Luxedeum shall delete or return all personal data within thirty (30) days, unless retention is required by applicable law.
D.10 Audit Rights. Enterprise customers may exercise reasonable audit rights to verify Luxedeum's compliance with this addendum, subject to reasonable notice and confidentiality obligations.
